Terms and Conditions
The client/passenger hereby acknowledges that Nile Travel International is not a carrier or keeper of airlines, hotels and refreshments. Nile Travel will arrange tickets, bookings and reservations, only as agent for its clients, who accept the same, subject to these Terms and Conditions below and those of each of the concerns with whom Nile travel may make arrangements for its clients.
Reservations & Payment for Accompanied Tour Bookings with Kim Lings
A non-refundable deposit of R10 000 (or otherwise stated) per person is required when booking on a Nile Travel Accompanied Tour. On receipt of your deposit a confirmation e-mail with further information will be sent to you. Final payment for the tour will be due 12 weeks prior to departure (or otherwise stated).
While every effort will be made to keep the advertised price fixed, Nile Travel reserves the right to adjust the price to accommodate increases in the event of a fluctuating rand/dollar/euro exchange rate, hotel rate increases, airline increases etc. until full payment has been received.
The cost of group tours is based on a minimum of 16 persons and a maximum of 26 persons (or otherwise stated). In the event that the minimum number is not achieved, Nile Travel reserves the right to cancel/postpone the tour and all payments will be refunded to the client/passenger.
Reservation and Payment for Individual Bookings
On written confirmation from Nile Travel that your booking has been confirmed a R5 000 (or otherwise stated) per person deposit is required. Airlines normally require full payment 72 hours after confirmation of all flights. Final payment on the balance owing must be made 6 to 8 weeks prior to departure (or otherwise stated). Nile Travel reserves the right to cancel the reservation and apply cancellation charges should payment not be received by the due date. The price quoted is subject to the rand/dollar/euro exchange rate, airline and hotel increases until full payment has been received.
Methods of Payment
Nile Travel only accepts payment by bank transfer. Please note that payments made by cheque are subject to 10 days’ bank clearance. If cash is deposited into Nile Travel’s account the client is responsible for the bank charges. Unfortunately no credit card payments can be accepted.
Cancellation and Curtailment
Any cancellation made by the client/passenger for any reason whatsoever must be in writing and the client/passenger shall be liable for all loss, damages and expenses incurred by Nile Travel in respect of making the booking and cancelling the same and for all payments which Nile Travel may lawfully require by reason of the cancellation. Nile Travel shall be under no obligation to repay the client any monies held by Nile Travel until such time as Nile Travel has computed all the expenses, loss, damages and deduction, which it is entitled to make in terms of this clause. The client/passenger irrevocably and specifically agrees that Nile Travel will be entitled to deduct any commission and/or profit which Nile Travel would’ve earned had the client/passenger not cancelled the reservation.
From the time of the confirmed booking up to 8 weeks prior to departure, the deposit is forfeited. Subject to the above, the following amounts, or such greater charge as levied by Nile Travel’s suppliers, will be charged:
More than 2 months prior to departure - cancellation rates charged by airline and/or hotels, cruise etc.
2 months prior to departure - 50 %f total tour price
1 month prior to departure: 100 % of total tour price
Amendments and all cancellations en route must be made with our overseas operators directly and Nile Travel should be advised as soon as possible. Please note that en route cancellations and amendments may incur additional fees as determined by our overseas operators and should be paid directly to them.
Nile Travel reserves the right to cancel your booking prior to departure where in its discretion, circumstances justify cancellation. Where cancellation is not due to any fault of yours, the total price paid will be refunded in full and final settlement of any further obligations on the part of Nile Travel which shall not be liable for any claims, loss or damage, consequential or otherwise. Whilst every effort is made to adhere to your itinerary, Nile Travel, reserves the right to make any changes it believes are warranted or necessary.
Nile Travel incurs no liability or responsibility for any delays prior to departure or during any tour howsoever arising including those due to technical problems, strikes, lock-outs, weather conditions or any other foreseen or unforeseen circumstances and all expenses related to any delays such as hotel accommodation, meals, airfares, telephone calls and the like will be for the passenger’s account.
Nile Travel does not hold itself responsible nor can it be held responsible for any delays prior to departure or during the course of any tour mentioned in the itinerary whether brought about by technical difficulties, strikes, weather conditions or any other circumstances whatsoever, whether foreseen or unforeseen. It is understood that any expenses relating to these unscheduled extensions (e.g. hotels, meals, airfares, telephone calls, etc.) will be for the client/passenger’s account.
Documentation is only prepared on receipt of full and final payment of your booking. All clients/passengers will be personally responsible for ensuring that they are in the possession of the correct documentation prior to their departure. Nile Travel does not accept responsibility for any consequences whatsoever from a client/passenger failing to ensure that he or she has complied with the necessary health, passport and visa requirements. Nile Travel is not responsible for the loss of any passports, airline tickets or documentation by a third party including but not limited to courier companies and visa agents.
Passport, Visas, Vaccinations, Inoculations and re-entry permits
The responsibility to obtain correct, current and valid passports, visas, vaccinations, inoculations and re-entry permits where required is that of the client/passenger alone. Nile Travel will not be held responsible or liable for any consequence of any nature arising from the client/passenger failing to ensure that he/she has complied with all such requirements.
Responsibility and Liability
Nile Travel makes every effort to ensure that all arrangements and services connected with your tour will be carried out as specified in the most efficient and effective way possible. However, we do not have direct control over the provision of services by suppliers and whilst they are in all cases selected with the utmost care, we do not accept liability for error and omissions of such suppliers.
Nile Travel accepts your booking strictly on the basis that it shall not be liable for any loss or harm, delay, damage or injury to property or person, even death, howsoever caused and howsoever arising, including as a result of any incident incurred in transportation on land or air or at sea and any error or default in carrying out the arrangements of the tour or any booking instructions or in connection with any lodging, accommodation or whatever. Nile Travel reserves the right to decline the acceptance of any person on any tour.
The passenger ticket in use by the airline, when used shall constitute the sale contract between the airline and passenger. The client/passenger acknowledges and agrees unconditionally that Nile Travel will not be liable for any loss, damage or injury arriving from air travel whether or not the carrier took all reasonable measure to avoid damage, loss or injury.
We strongly advise clients/passengers to take out insurance against cancellation, curtailment, illness, loss of baggage and default at the time of booking. The client/passenger hereby indemnifies Nile Travel and hold Nile Travel harmless for any and all damage, loss or injury, which may be sustained by the passenger in the course of the tour.
Refunds and Unused Services
No refunds will be made for no-shows or any unused services irrespective of whether they form part of the basic inclusive tour price, or whether they are in respect of pre-booked optional arrangements.
Prices quoted do not include airport or departure taxes, costs of obtaining visas and passports unless stipulated. The price does not include the cost of personal telephone calls, laundry, entertainment arrangements not shown in the itinerary, meals and beverages unless specified, or any other items of a personal nature.
Special requests should be specified at the time of booking. Whilst every effort will be made to comply, under no circumstances can Nile Travel guarantee that they will be met.
Receipt of your deposit and/or full payment shall constitute your agreement that you and those for whom you make any bookings, are agreeable to and are bound by the terms and conditions of Nile Travel.
Nile Travel shall not be bound by any representation, warranty, promise or the like not recorded herein. No addition to, variation, or agreed cancellation of these Terms and Conditions shall be of any force of effect unless reduced to writing and signed by or on behalf of Nile Travel. No indulgence, which Nile Travel may grant to the client/passenger, shall constitute a waiver of any of the rights of Nile Travel, who shall not thereby be precluded from exercising any rights arisen in the past or which might arise in the future.
In the event of Nile Travel having to institute legal action against the client/passenger for any amount outstanding by the client/passenger to Nile Travel, the client/passenger shall be liable for Nile Travel’s legal fees on the scale as between attorney and client, including collection commission and tracing fees.
